Jean-Paul Sartre en El ser y la nada plantea una ontología basada en la dualidad fundamental del ser y una nada que, ante todo, se describe como un acto nihilizador. En virtud de una fuerte presencia de dinámicas activas en la ontología sartreana, esta investigación tiene por objetivo identificar el rol de la pasividad en la ontología y en la fenomenología sartreanas, con vistas a resaltar la necesidad de la dimensión pasiva en, al menos, dos fenómenos cruciales en la constitución (...) fáctica del para-sí, a saber, por un lado, la situación del cuerpo-para-sí y, por otro, el aparecer del otro a través de la mirada. Para este objetivo se recurrirá a la ontología merleaupontiana en torno a la pasividad expuesta en Lo visible y lo invisible a modo de guía. Con ello, la hipótesis a sostener es que hay un importante recurso a la pasividad en la fenomenología de la situación del cuerpo-para sí, agudizado con el aparecer del otro, el cual, no obstante, se ausenta en la exposición ontológica. In this article we propose to carry out an examination of the notions of ‘other’ based on the philosophical proposals of Maurice Merleau-Ponty and Maurice Blanchot. It seeks to show the common point between both thoughts, from a proposal in which the other is understood as a dislocation, which manifests itself in the way of an opening. For this reason, the notion of opening becomes the central element of this analysis, from which the other manifests itself in an ambiguous way. (...) To this end, the proposals of both authors will be analyzed separately, however, highlighting and relating to each other their respective conceptions of opening and the implications they have regarding the question of the other. The sphere of disability can be treated nowadays from different perspectives that answer to multidimensional of this embodied reality. In this context, a privileged area of reflection is constituted by ethics and, inside of this, as this text propose, the prism of the reciprocal recognition. To achieve this, this present article is structured in two parts. The first, regarding to the understanding of disability from different models. The second, according to the recognition perspective approach of Honneth, and its link with (...) the disability, presents the three stages of recognition with their corresponding ways of disdain. In the late 1990s, Mexican feminists mobilized transnationally to demand state accountability for the feminicidios of women in Ciudad Juarez. Feminicidio refers to the misogynous killing of women and the state’s complicity in this violence by tolerating it with impunity. Drawing on debates of the Mexican Federal Congress and interviews with feminist state and non-state actors, I examine feminist legislators’ response to transnational activism, which was to pass the “General Law on Women’s Access to a Life Free of Violence” and (...) to create the penal-type code of feminicidio, which includes provisions to punish negligent state actors. These laws make the state a target of its own punitive power. To pass these acts, feminist legislators faced resistance from male legislators and the Federal Executive. I build on feminist institutionalism to theorize this resistance as gendered. Gendered state resistance was pervasive because feminist legislators practiced accountability by identifying the complicity of state institutions, including Congress, in perpetuating feminicidio. As part of the process, they built alliances with other female legislators and framed their arguments with notions of modern statehood. Although this framing strategy resulted in innovative legal change, I interrogate the assumption that modernity is the solution to feminicidio, because it can lead gendered state resistance to manifest as a simulation of accountability. Claims concerning the death of the nation-state are often accompanied by postnationalist arguments that emphasize the potential of human rights to contest nation-bounded conceptualizations of membership. Conversely, arguments focusing on the continuing importance of state-bounded social citizenship rights undermine such postnationalist claims. To assess these claims, this article turns to the Irish state and its prohibition of abortion except in cases where the life of the pregnant woman is in danger. The authors focus their analysis on four legal cases that (...) unfolded between 1992 and 2010. These cases reflect how specific women’s social location within interconnected power hierarchies of nationality, gender, class, race/ethnicity positioned them differently vis-a-vis the Irish state, international and supranational bodies. Furthermore, the transnational, in the form of immigration, non-governmental organizations and the Catholic Church, plays an important role in structuring the context within which these cases unfold. Rather than showing that the international, supranational and transnational are conduits for the declining power of the nation-state, this article finds that in the increasingly dense legal-political field there is room for all of these forces. We are frequently confronted with moral situations that are unsettling, confusing, disorienting. We try to come to grips with them. When we do so, we engage in a distinctive type of moral inquiry: hermeneutical inquiry. Its aim is to make sense of our situation. What is it to make sense of one's situation? Hermeneutical inquiry is part of our everyday moral experience. Understanding its nature and its place in moral epistemology is important. Yet, I argue, that existing accounts of moral (...) inquiry do not give us the resources to do so. This paper develops a positive account of hermeneutical inquiry. I argue that when we engage in hermeneutical inquiry, we search for an apt perspective on our situation. (shrink)

To have moral worth an action not only needs to conform to the correct normative theory ; it also needs to be motivated in the right way. I argue that morally worthy actions are motivated by the rightness of the action; they are motivated by an agent's concern for doing what's right and her knowledge that her action is morally right. Call this the Rightness Condition. On the Rightness Condition moral motivation involves both a conative and a cognitive element—in particular, (...) it involves moral knowledge. I argue that the Rightness Condition is both necessary and sufficient for moral worth. I also argue that the Rightness Condition gives us an attractive account of actions performed under imperfect epistemic circumstances: by agents who rely on moral testimony or by those who, like Huckleberry Finn, have false moral convictions. Moral understanding is a valuable epistemic and moral good. I argue that moral understanding is the ability to know right from wrong. I defend the account against challenges from nonreductionists, such as Alison Hills, who argue that moral understanding is distinct from moral knowledge. Moral understanding, she suggests, is constituted by a set of abilities: to give and follow moral explanations and to draw moral conclusions. I argue that Hills’s account rests on too narrow a conception of moral understanding. Can moral ignorance excuse? This chapter argues that philosophical debate of this question has been based on a mistaken assumption: namely that excuses are all-or-nothing affairs; to have an excuse is to be blameless. The chapter argues that we should reject this assumption. Excuses are not binary but gradable: they can be weaker or stronger, mitigating blame to greater or lesser extent. This chapter explores the notions of strength of excuses, blame miti- gation and the relationship between excuses and moral (...) responsibility. These ideas open up some principled middle-ground between the two positions staked out in the literature. Moral ignorance may well excuse but it does not exculpate. (shrink)

Excuses are commonplace. Making and accepting excuses is part of our practice of holding each other morally responsible. But excuses are also curious. They have normative force. Whether someone has an excuse for something they have done matters for how we should respond to their action. An excuse can make it appropriate to forgo blame, to revise judgments of blameworthiness, to feel compassion and pity instead of anger and resentment. The considerations we appeal to when making excuses are a motley (...) bunch: tiredness, stress, a looming work deadline, a wailing infant, poverty, duress, ignorance. What unifies these various considerations as a class? In virtue of what can they all excuse? And what does their normative force consist in? This paper aims to develop a unified account of excuses: what they are and what they do. In a nutshell, I argue that excuses are considerations that show that an agent’s wrongdoing does not manifest a specific motivational failing: namely, the lack of a morally adequate present-directed intention. What do excuses do? I suggest that they function as responsibility-modifiers. They alter how the wrongdoer, the wronged party, bystanders may morally respond to a wrong, without negating that it remains appropriate to respond in some way. (shrink)

Analizarlo a través de la teoría del bienestar permite acercarse a los preceptos de un cognitivismo ético o de psicología moral, mediante una propuesta distinta de individuo representativo. La finalidad es ofrecer algunos elementos para observar a la economía desde otra perspectiva, al estrechar los lazos teóricos con la ética.

When you don’t know what to do, you’d better find out. Sometimes the best way to find out is to ask for advice. And when you don’t know what the right thing to do is, it’s sometimes good to rely on moral advice. This straightforward thought spells serious trouble for a popular and widespread approach to moral worth: on this approach, agents deserve moral praise for a right action only if they are acting on right-making reasons. The first part of (...) this paper argues that cases of moral advice present right-making reasons accounts with a dilemma: depending on how we make the right-making relation precise, we either have to deny that agents who seek out and follow moral advice are morally praiseworthy or we have to credit morally wrong actions by unsavory characters with moral worth. This casts doubt on the claim that acting on right-making reasons can be both necessary or sufficient for moral worth. The second half of the paper explores an alternative proposal: what’s required for moral worth is moral knowledge. This idea has been unpopular in recent literature. What is it to take responsibility for a moral failure? This chapter investigates taking responsibility for wrongdoing. It starts by considering a prominent view in the literature: that to take responsibility for a wrong is to blame oneself for it. Contrary to the self-blame account, it is argued that taking responsibility and self-blame can come apart in various ways. Instead, the normative footprint account is defended. It is suggested that wrongdoing changes the normative landscape in systematic ways: it can create (...) duties to apologize, to acknowledge the wrong done, to make amends, to respond to the wronged party’s upset. To take responsibility for a wrong is to own the normative consequences of one’s wrong. (shrink)

Various organizational factors reported in the hitherto literature affect individual behaviour within a company. In this paper, we conduct a literature review thereof, and propose a notion of the “Organizational Moral Structure” defined as a comprehensive framework of interrelated organizational factors that condition, incite or influence good or bad moral behaviour of individuals within the organization. Drawing from a wide bibliographical review and our own reflection on recent business scandals, we identify seven constituents of the “Organizational Moral Structure”: 1) leader’s (...) values and character, 2) vision and exercise of power, 3) corporate control systems, 4) internal network of influence, 5) organizational culture, 6) internal and competitive pressures, and 7) external influences. The “Organizational Moral Structure” is proposed as a reflective framework for humanistic management and as an invitation to further research in this field. We provide recommendations on how a manager oriented towards humanistic management can use the OMS to secure and promote well-being and dignity of company’s employees. (shrink)

In the course of a career that spans half a century, from the Vietnam era to the America of Barack Obama, Sam Shepard has often been labelled as a “quintessentially American” playwright. According to Leslie Wade, “[d]rawing from the disparate image banks of rock and roll, detective fiction, B-movies, and Wild West adventure shows,” Shepard’s texts “function as a storehouse of images, icons, and idioms that denote American culture and an American sensibility”. The article addresses Shepard’s work in the 1990s, (...) when—as suggested by Stephen J. Bottoms—the writer’s prime concern was with depicting “a Faustian nation mired in depravity and corruption”. The discussion centres primarily upon a brief anti-war play first presented by the American Place Theatre in New York City on 30 April 1991, States of Shock, whose very title appears to sum up much of the dramatist’s writing to date, aptly describing the disturbing atmospheres generated by his works and the sense of disorientation frequently experienced by both Shepard’s characters and his audiences. The essay seeks to provide an insight into this unsettling one-act play premiered in the wake of the US engagement in the First Gulf War and deploying extravagant, grotesque theatricality to convey a sense of horror and revulsion at American military arrogance and moral myopia. It investigates how Shepard’s haunting text—subtitled “a vaudeville nightmare” and focusing on a confrontation between a peculiar male duo: an ethically crippled, jingoistic Colonel and a wheelchair-using war veteran named Stubbs—revisits familiar Shepard territory, as well as branching out in new directions. It demonstrates how the playwright interrogates American culture and American identity, especially American masculinity, both reviewing the country’s unsavory past and commenting on its complicit present. Special emphasis in the discussion is placed on Shepard’s preoccupation with the aesthetics of performance and the visual elements of his theatre. The essay addresses the artist’s experimental approach, reflecting upon his creative deployment of dramatic conventions and deliberate deconstruction of American realism. (shrink)

Proceeding from the double assumption that accounts of the origins of normativity circulated in antiquity and modernity are unsatisfactory, and the determinacy of norms remains a central problem not only for moral theory but also for epistemology, political theory, and even medicine, the author contends that the realm of lived experience can help (...) us furnish determinate though often pre-thetic norms that can underwrite or justify “non-moral normative distinctions,” such as the distinction between the just and the unjust in political theory and the distinction between the normal and the pathological in medicine. With the aid of comparative and hermeneutic analysis, the author establishes that Merleau-Ponty’s Phenomenology of Perception shares with Canguilhem’s The Normal and the Pathological a similar understanding of the norming and normative character of subjective experience and, moreover, that in these works one can find a “pathic” theory of norms that can give us, as the author puts it, “a new foundation for the very possibility of critique” in our post-Enlightenment moment. The eighteenth‑century English writer Matthew Gregory Lewis wrote one of the most dramatic Gothic novels, The Monk; over 200 years later, a film of the same name appeared, based on the novel and directed by Dominik Moll. The film, a free adaptation of the book, presenting the story of the moral downfall of the monk Ambrosio, has inspired us to philosophical reflections on sexuality, sensuality, and physical desire. We have attempted to analyze and interpret this cinematic work of art in (...) the context of these issues. The method we have adopted is based on a thorough discussion of the topics developed in the film and related issues. This method, while not pretending to be scientific objective, enables us to outline an interesting field of research as well as to identify a number of theoretical problems and questions that remain open. The formula we have adopted is to quote lines from the film The Monk which permits the analysis of selected issues related to sexuality, sensuality, and physical desire. Any plausibly just market exchange must balance two conflicting moral considerations: non-worseness (Wertheimer, 1999) and euvoluntariness (true voluntariness; Munger, 2011). We propose an analytical theory of just market exchange that partly resolves this conflict.

To grasp the uniqueness of the human person is not yet to grasp the specific nature of personal health. But it is certainly a first step, and it becomes evident that every theory of human health presupposes a theory of the person. Accordingly, the debate presented in this book is no less a debate about the nature of the human person than it is a debate about the nature of health.The investigations offered in this volume intend to provide an impetus for new conceptions of personhood and human health. The phenomenological approach has the advantage of advocating a systematic conception of the total person which combines surface experiences (subjective experiences of well-being) with deeper dimensions of the person (value and being). An adequate conception of the human person has enormous implications not only for our understanding of what constitutes the health and well-being of the person, but also for our conception of what health care should comprise. The chapter reports on the findings of a grounded theory study on the moral sensitivity practice of Filipino college deans. It centers on the exposition of a conceptual model which expands the construct of moral sensitivity beyond the initial stage of moral problem recognition and depicts three processes of knowing facts, understanding people, and understanding oneself as fundamental processes to moral sensitivity. A set of seven distinct practices were also identified as subcomponents of moral sensitivity. The chapter concludes by highlighting (...) the level of complexity involved in moral problem identification in real-life settings and the consequent need for developing administrators’ moral sensitivity skills through formal courses in ethics as part of school administrator preparation programs. This article presents the author’s main assumptions of two professors’ ethical theories – Vasil Gluchman and Grzegorz Grzybek, that is: “ethics of social consequences” and “ethics of development”. It presents the similarity of “ethics of social consequences” to “ethics of reverence for life”. It shows the definition of the act, the nature, types and its special place in the two theories. It highlights three major historical perspectives on the standard of morality: eudaimonism, deontonomism, personalism. It relates these considerations to the (...) analyzed theories. At the end, a new dimension of the act in the context of the present day is indicated. It is, of course, to help people in need, the poor and the hungry. There is a reference to Peter Singer, whose philosophy was the inspiration for V. Gluchman and G. Grzybek. The summary can be a significant remark that the pursuit of high moral standards leads one on the right track of procedure. Thinking about morality in terms of “black – white” is a mistake. Life has more shades. Therefore, we should praise people for much better deeds than these, which most people can afford, and rebuke – for a lot worse. If someone does more than he should, it is hard to scold him that he does not do much more. (shrink)

In developing artificial intelligence (AI), researchers often benchmark against human performance as a measure of progress. Is this kind of comparison possible for moral cognition? Given that human moral judgment often hinges on intangible properties like “intention” which may have no natural analog in artificial agents, it may prove difficult to design a “like‐for‐like” comparison between the moral behavior of artificial and human agents. What would a measure of moral behavior for both humans and AI look like? We unravel the (...) complexity of this question by discussing examples within reinforcement learning and generative AI, and we examine how the puzzle of evaluating artificial agents' moral cognition remains open for further investigation within cognitive science. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

This phenomenological study intends to capture and describe Filipino college deans’ lived experiences of ethical dilemmas as they carry out their work as administrators. Using semistructured in-depth interviews and following Collaizzi’s method, data was collected and subjected to cool and warm analyses yielding a set of themes and sub-themes that typify what these deans consider to be ethical dilemmas. The resulting ‘Wheel’ of School Leaders’ Ethical Dilemmas depicts the nature of the dilemmas faced by these deans, the critical incidents which (...) trigger the onset of the dilemmas, and the value conflicts that are embedded in them. This article intends to add to the growing body of research on ethical decision making in educational management, particularly on the ethical dilemmas faced by Filipino college deans. At a practical level, the findings of this study provide valuable resource to assist practicing and aspiring deans to be more adept in identifying the moral and ethical dimensions of their work as academic administrators. Finally the findings of this study could serve as a knowledge base for curriculum planners in designing ethics courses offered in educational leadership programs in the Philippines to develop academic leaders’competencies and skills in ethical decision making. The current human rights framework can shield people from many of the risks associated with neurotechnological applications. However, it has been argued that we need either to articulate new rights or reconceptualise existing ones in order to prevent some of these risks. In this paper, we would like to address the recent discussion about whether current reconceptualisations of the right to mental integrity identify an ethical dimension that is not covered by existing moral and/or legal rights. The main challenge of (...) these proposals is that they make mental integrity indistinguishable from autonomy. They define mental integrity in terms of the control we can have over our mental states, which seems to be part of the authenticity condition for autonomous action. Based on a fairly comprehensive notion of mental health (ie, a notion that is not limited to the mere absence of illness), we propose an alternative view according to which mental integrity can be characterised both as a positive right to (medical and non-medical) interventions that restore and sustain mental and neural function, and promote its development and a negative right protecting people from interventions that threaten or undermine these functions or their development. We will argue that this notion is dissociated from cognitive control and therefore can be adequately distinguished from autonomy. (shrink)

La arqueología ha revelado recientemente la existencia de una importante revitalización urbana en Córdoba durante el Califato Almohade, apenas tratada hasta ahora por la historiografía, centrada principalmente en su pasado omeya. Por un lado, se ha observado una importante inversión del poder almohade en elementos defensivos y palatinos, acaso por tratarse en estas fechas de un centro fundamental en la conceptualización histórica de al-Andalus y en la lucha contra los reinos cristianos; por otro, se ha documentado un importante crecimiento orgánico (...) y privado extramuros. Todo ello coincidió con su elección como capital andalusí en 557/1162 por ‘Abd al-Mu’min, lo que suponía un hito fundamental para la legitimación de su nuevo califato. Tras su muerte pocos meses después, Abū Ya‘qūb Yūsuf hizo regresar la corte a Sevilla, creando un importante cambio de rumbo en la política almohade que no afectó al resurgir urbano de la antigua sede omeya. Marcel Gauchet to mało znany w Polsce historyk i filozof francuski. Żadna z jego książek nie została do tej pory przetłumaczona na język polski. Dostępny w tym języku jest jeden z esejów pochodzący z La démocratie contre elle-même (Demokracja przeciwko sobie samej), opublikowany w kwartalniku „Res Publica Nowa” w grudniu 2002 r. pt. Nowy wiek osobowości. Próba psychologii współczesnej, przełożony i opracowany przez Wiktora Dłuskiego. W tekście tym Gauchet stawia tezę o mającej miejsce we współczesnym świecie rewolucji antropologicznej, polegającej na (...) zmianie roli rodziny ze wspólnoty ustanawiającej i podtrzymującej więzi społeczne na grupę społeczną niemającą wpływu na kształt życia społecznego. Przybliżenie sylwetki Gaucheta wydaje się niezbędne, albowiem jego myśl stanowi ważki i godny uwagi głos w dyskusji nad stanem współczesnej polityki oraz świata. -/- W niniejszym artykule skupię się na dwóch poruszonych przez Gaucheta zagadnieniach. Pierwsze z nich to ideologiczne konsekwencje ostatniego kryzysu gospodarczego, m. in. pokonanie lewicowej frakcji politycznej przez prawicową czy kryzys demokracji objawiający się dominacją interesów jednostkowych nad wspólnotowymi. Drugą kwestię stanowi kryzys liberalizmu polegający na występowaniu dwóch sprzecznych trendów na scenie politycznej, mianowicie,dominacji idei państwa interwencjonistycznego, dążącego do zbudowania dobrze funkcjonującego państwa opiekuńczego oraz rosnącego w siłę domagania się praw jednostki, co odbywa się, zdaniem Gaucheta, kosztem państwa. -/- Źródła będące podstawą niniejszego tekstu to przede wszystkim wywiad Macieja Nowickiego z Marcelem Gauchetem pt. This paper argues that epistemic errors rooted in group- or identity- based biases, especially those pertaining to disability, are undertheorized in the literature on medical error. After sketching dominant taxonomies of medical error, we turn to the field of social epistemology to understand the role that epistemic schemas play in contributing to medical errors that disproportionately affect patients from marginalized social groups. We examine the effects of this unequal distribution through a detailed case study of ableism. There are four primary (...) mechanisms through which the epistemic schema of ableism distorts communication between nondisabled physicians and disabled patients: testimonial injustice, epistemic overconfidence, epistemic erasure, and epistemic derailing. Measures against epistemic injustices in general and against schema-based medical errors in particular are ultimately issues of justice that must be better addressed at all levels of health care practice. Plausibly, you should believe what your total evidence supports. But cases of misleading higher-order evidence—evidence about what your evidence supports—present a challenge to this thought. In such cases, taking both first-order and higher-order evidence at face value leads to a seemingly irrational incoherence between one’s first-order and higher-order attitudes: you will believe P, but also believe that your evidence doesn’t support P. To avoid sanctioning tension between epistemic levels, some authors have abandoned the thought that both first-order and higher-order evidence (...) have rational bearing. This sacrifice is both costly and unnecessary. We propose a principle, Evidential Calibration, which requires rational agents to accommodate first-order evidence correctly, while allowing rational uncertainty about what to believe. At the same time, it rules out irrational tensions between epistemic levels. We show that while there are serious problems for some views on which we can rationally believe, “P, but my evidence doesn’t support P”, Evidential Calibration avoids these problems. An important upshot of our discussion is a new way to think about the relationship between epistemic levels: why first-order and higher-order attitudes should generally be aligned, and why it is sometimes—though not always—problematic when they diverge. Interdisciplinary dialogue acts as a symbiosis for all the areas that participate and imply enormous projections for both art and science. This paper explores the potential of an interdisciplinary dialogue between Biology and Performance using as a case study the Performance Analfabeta created by the artist Paulina Bronfman. The work was shaped in the context of The Third Conference of the Nucleus of Artistic Research (NIA) of In/Inter/Disciplinary Laboratories hosted by the Faculty of Art of The Pontificia University of (...) Chile (LAB IID). The Lab was led by Chilean biologist Alejandra Zuñiga- Feest and the Brazilian artist Adriana Parente La Selva. This work aims to explore the questions: what does it mean, from the point of view of the arts and sciences, to develop an interdisciplinary laboratory? How is this done? This paper problematizes the creative process of collaboration between sciences and performance as well as the potential impact and link with society that this multidisciplinary dialogue can have. What is the relationship between understanding and knowing? This paper offers a defence of reductionism about understanding: the view that instances of understanding reduce to instances of knowing. I argue that knowing is both necessary and sufficient for understanding. I then outline some advantages of reductionism.
